By accessing and using John Henry Homes, Inc.’s (“JHH”) website you (“You” or “Your”), the visitor of the JHH website, agree to these terms and conditions (the “Terms and Conditions”):

  1. Not an Offer to Sell. Neither the JHH website, nor any information contained thereon, constitutes an offer or promise to sell any real property or improvements.  Any home listed on the JHH website is subject to a prior sale.
  2. Informational Purposes Only. You acknowledge and agree that the information contained on the JHH website is intended to be for informational purposes only, and does not constitute any representation, guaranty or warranty, whether express or implied, regarding any JHH real property, improvements, products and/or services.  Any and all information on the JHH website, including pricing information, is subject to change, in JHH’s sole discretion, without any prior notice to You.  Some or all photographs, renderings, drawings, floorplans and other promotional materials on the JHH website may vary from the actual plans and homes built by JHH.  Any plans, interior and exterior depictions may contain options that are not standard or available on other JHH homes.  JHH reserves the right to make changes to any floorplans, specifications, dimensions and elevations of its homes listed on the JHH website without prior notice.  All stated dimensions and square footage listings are approximate and should not be used, or relied upon, as representation of actual dimensions or square footage of any JHH home.
  3. Community Information. Information about communities identified on the JHH website may not be accurate or current.  JHH reserves the right, in its sole discretion, to update, change or remove information about any such communities, without any prior notice to You.
  4. Disclaimer. All or any content and information on the JHH website may include inaccurate or typographical errors.  To the fullest extent permitted by law, in no event shall JHH be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, in any way, or connected with, Your use of the JHH website, whether based in contract, tort, strict liability or otherwise.  JHH expressly disclaims, and does not assume, any liability or responsibility for any errors or omissions in the content on the JHH website including, but not limited to, dimension, square footage, zoning and pricing information.  All content on the JHH website is provided to You “as is, where is.”  JHH expressly disclaims all warranties or conditions, express or implied, as to any matter whatsoever relating to or referenced by the JHH website, including, without limitation, implied warranties of merchantability, fitness for particular use, quality, condition or non-infringement.

All content on the JHH website, including but not limited to, floor plans, renderings, drawings and photographs, are copyrighted material and may not be distributed, reproduced, modified, in whole or in part, or otherwise used, without the prior written consent of JHH.  Use of the JHH website and its content is subject to all copyright and intellectual property laws.
  7. Updates. JHH may, at any time and in its sole discretion, revise these Terms and Conditions by updating the JHH website.  You are bound by any such revision, whether receiving notice of the revision, and should always refer to these Terms and Conditions each time you access the JHH website to determine whether the Terms and Conditions have been revised.
  8. Equal Housing Opportunity. JHH is subject to all Ohio and Federal laws including equal housing opportunity laws.  Pursuant to such state and federal laws, and similar laws, rules and regulations, it is illegal to refuse to sell, transfer, assign, rent, lease, sublease or finance housing accommodations, refuse to negotiate for the sale or rental of housing accommodations, or otherwise deny or make unavailable housing accommodations because of race, color, religion, sex, familial status, ancestry, disability or national origin.

PRIVACY POLICY

By accessing and using John Henry Homes, Inc.’s (“JHH”) website, you consent to JHH’s collection, use and disclosure of your information in accordance with this privacy policy (“Privacy Policy”) and you agree to be legally bound by its terms.  This Privacy Policy is incorporated by reference into JHH’s Terms and Conditions and is a part of the terms and conditions contained therein.

  1. Collection of Personal Information; Use. In order to provide JHH’s products and/or services to you, it may be necessary for JHH to request personal information including, but not limited to, your name, address, telephone number, electronic mail address and other information.  Your provision of such personal information is always voluntary.  Along with allowing JHH to potentially provide you products and/or services, your personal information is used by JHH to contact and correspond with you, to respond to your inquiries, to process transactions and payments, to facilitate and enhance your use of the JHH website, to alert you to JHH’s services and those of JHH’s affiliates and partners, and for other purposes.  Any information or material you transmit to, or through, the JHH website, including any data, questions, comments, suggestions or the like, will be treated as non-confidential and non-proprietary information.
  2. Collection of Non-Personally Identifiable Information; Use. JHH may automatically collect certain non-personally identifiable information regarding JHH website users.  Such information may include, without limitation, the Internet Protocol (“IP”) address of your computer, your device ID, the IP address of your Internet service provider, your zip code, the date and time you access the website, the Internet address of a referring website, the operating system you are using, the sections or pages of the JHH website that you visit, and the images and content viewed.  Non-personally identifiable information can be used by JHH for any lawful purpose and may be shared with any number of third parties, provided that such information does not specifically identify you.  Such information may be permanently archived for future use.
  3. Security. JHH cannot ensure or warrant the security of any information you transmit to JHH and you so transmit at your own risk.
  4. Links to Other Websites. The JHH website may contain links to other websites of interest.  However, once you have used these links to leave the JHH website, you acknowledge and agree that JHH does not have any control over that other website.
  5. Privacy Policy Changes. JHH has sole discretion to change, modify, add or remove portions of this Privacy Policy from time to time.  New versions of the Privacy Policy will be posted on the JHH website.  JHH’s collection, use or disclosure of your information will be governed by the version of this Privacy Policy in effect at the time of such collection, use or disclosure.  If JHH materially changes the way it collects, uses or discloses your personal information, we will notify you through a notice or updated Privacy Policy on the JHH website, or by electronic mail (sent to the email address you have provided to JHH), prior to or upon the change(s) becoming effective.  Accordingly, when you access or use the JHH website, you should check the date of this Privacy Policy and be aware of any changes since the last version.  Your continued use of the JHH website following the posting of any changes to this Privacy Policy means that you accept such changes.
